Commitment Inserts

Inserts, in standard industry format, ready for inclusion within a commitment. The insert is the result of a full examination of title, including a twenty (20) year name search of all parties appearing in the chain. The status of real property taxes and special assessments is reported. Copies of the vesting deed, open mortgages, liens, judgments, defective instruments, or other objectionable matters are routinely provided. If all information necessary to prepare the commitment is furnished, the insert is supplied signature ready. This product is available only to licensed title insurance issuing agents and underwriters.

Ownership & Encumbrance Reports

An “O&E” is the result of a simple search of the record from the last arms-length deed to a current date. It reveals the apparent record title holder (as indicated by that deed) and any encumbrances noted in that deed, or any subsequently recorded deed. The certificate makes no representation as to the legal sufficiency of title, or of any instrument reported therein. The certificate form has been filed with, and approved by the Florida Department of Insurance in accordance with Section 627.7843, Florida Statutes. Copies of the vesting deed and any mortgages, liens or judgments are provided.

Foreclosure Reports

Prepared in contemplation of the foreclosure of a specific mortgage, mechanic’s or homeowner’s association lien, this report is tailored to fit the need of an attorney preparing a complaint in foreclosure. In addition to reporting those matters common to the subdivision, the report reveals those matters of record that should be addressed by the foreclosing attorney, such as other mortgages, liens, judgments, pending litigation, etc. The Foreclosure Report embodies a full examination of title, and copies of the vesting deed, open mortgages and other items referred to are provided.

Risk Analysis Reports

The format of this report is similar to a standard ALTA commitment form, and is intended to be used by those title insurance agents who prefer to prepare their own commitment inserts. Recommended requirements and exceptions are provided. The Risk Analysis Report is the result of a full examination of title, including a twenty (20) year name search of all parties appearing in the chain. The status of real property taxes and special assessments is reported. Copies of the vesting deed, open mortgages, liens, judgments, defective instruments, or other objectionable matters are routinely provided.

Fixed Period Searches

This report constitutes a search of the public records from a specific date, and reports all matters appearing of record subsequent to that date, including the current status of real property taxes. No abstractor or examiner discretion is exercised in the preparation of this report. If an item is found of record, the item is reported, and a copy of same is provided.

Judgment Lien Searches

The product of this search is a revelation of any open liens or judgments filed of record against a specific name within the most recent twenty (20) years. Only those items not previously released or satisfied will be reported. Copies of all items will be furnished.

Title Status Reports

This report is commonly tailored to fit the specific need of the customer, but generally reports the current status of title, as revealed by the public record. It notes those matters that would require some corrective action in order to render title marketable in the current fee title holder with no exceptions other than those common to the subdivision or area in which the land is located. For the most part, these reports are used by lawyers in identifying some particular title problem, or to establish the status of title as it related to some specific probate or litigation matter. Copies of the vesting deed, open mortgages, liens, judgments, defective instruments or other matters requiring some corrective action are routinely provided.

Environmental History (EPA) Reports

This report is based on a complete search of the record title for the purpose of revealing a fifty year chain of ownership, any leasehold interests, easements, or other recordings that would provide information relative to the use of the land during the most recent fifty year period. The information is used by those engaged in performing environmental audits for the purpose of discovering any environmentally hazardous land use. In general, the only copies provided are of the last deed, and any other item which in the company’s discretion specifically suggests a possible environmental hazard.
